Shipping Policy

Prices

• Our prices are set out on our website in INR and are inclusive of GST where applicable.
• Prices remain in force until we publish new prices on our website.
• Delivery charges apply and are displayed during the order process.

Order Processing

• All orders are processed within 48 to 72 hours.
• Orders are not processed or shipped on weekends or public holidays.
• During periods of high order volume, shipments may be delayed by a few additional days.
• If there is a significant delay in the shipment of your order, we will notify you via email or phone.

Shipping Rates & Delivery Estimates

• Shipping charges applicable to your order will be displayed at checkout before payment.
• Delivery times vary depending on your shipping destination and the shipping method selected.
• Standard shipping generally takes between 5-7 business days.
• Delivery timelines are estimates only and are not guaranteed.

Delivery

• Delivery of products within India (for in-stock items) will normally be made within 5-7 working days from clearance of payment.
• Any dates specified for delivery are approximate only.
• We shall not be liable for any losses, costs, damages, charges or expenses arising from delays in delivery.
• If we or our suppliers are temporarily out of stock, we will notify you and dispatch may take up to 28 days.
• We will attempt to deliver products ordered by you to the delivery address entered at checkout and stated in your order confirmation.

Shipment Confirmation & Order Tracking

• Once your order has been shipped, you will receive a shipping confirmation email containing your tracking number(s).
• Tracking information generally becomes active within 24 hours after shipment.

International Shipping

Hero Pen India currently ships only within India. We do not offer international shipping at this time.

Restrictions on Shipping

• Certain products may be restricted from shipping to specific locations due to legal, regulatory or courier restrictions.
• If your order cannot be shipped because of such restrictions, we will notify you and provide additional information where possible.

Product Authenticity Guarantee

Hero Pen India is committed to providing genuine products.

• All products sold are genuine and sourced through authorized channels.
• We do not sell counterfeit, imitation or unauthorized products.
• Natural variations in handmade, handcrafted, resin, ebonite or limited-edition products are not considered defects.
• Hero Pen India does not provide any warranty on its products unless explicitly mentioned on the respective product page.

Limited Edition & Inventory Reservation Policy

Certain products may be produced in limited quantities.

• Limited edition products are subject to availability.
• Inventory displayed on the website may occasionally differ from actual stock levels.
• Orders for limited-edition or high-demand products may be cancelled and refunded if oversold.
• Orders are considered confirmed only upon dispatch.
• Pre-order items will be dispatched on the estimated date mentioned on the respective product page. Delivery timelines will be calculated from the date of dispatch and may change depending on availability and production schedules..

Order Acceptance Policy

• We must receive payment for the products and applicable delivery charges before we can accept your order.
• If you have provided your email address, you will receive an automated order confirmation email acknowledging that we have received your order request. This email is for confirmation purposes only and does not constitute acceptance of your order.
• Your order will be considered accepted only when it has been dispatched, and we send you a dispatch confirmation email. If no dispatch confirmation email is sent, acceptance of your order takes place upon delivery of the products. Only upon such acceptance is a binding contract created between you and Hero Pen India.
• Hero Pen India reserves the right, at its sole discretion, to refuse, cancel, or limit the quantity of any order. We may also cancel an order due to stock unavailability, pricing or typographical errors, suspected fraud, misuse of promotions, or any other legitimate business reason.

Availability

• All orders are subject to product availability.
• If products ordered are unavailable, we will notify you where possible.
• If payment has already been received for unavailable products, we will refund the applicable amount within 15 days unless you agree to a longer period.

Incorrect Shipping Address Policy

Customers are responsible for providing accurate and complete delivery information.

• We are unable to independently verify the accuracy of delivery addresses entered by customers.
• If products are returned to us as undeliverable due to an incomplete, incorrect or inaccurate address, we shall refund the price of the products minus any shipping and handling charges.
• Customers remain responsible for ensuring that all delivery details are correct at the time of placing the order.
• Returned parcels may incur additional reshipping charges.
• Original shipping fees may be non-refundable.
• Any additional courier charges arising from incorrect address information shall be borne by the customer.

Transfer of Risk and Ownership

• You will not become the owner of the products until they have been delivered to you.
• Upon delivery, risk in the products passes to you.
• We shall not be liable for any subsequent loss, theft, damage or destruction occurring after delivery has been completed.

Liability Related to Delivery

If products delivered to you are Not as ordered, damaged, Defective or of incorrect quantity,

you must contact us within 2 days of receipt.

Upon verification, we may:

• Replace the incorrect, damaged or defective products;
• Make good any shortfall in quantity; or
• At our discretion, refund the price and delivery charges associated with those products.

Shipping Delays & Carrier Responsibility

While we make every effort to ensure timely delivery:

• Delivery timelines are estimates only and are not guaranteed.
• Delays may occur due to circumstances beyond our reasonable control.
• Hero Pen India shall not be liable for shipping delays caused by third-party carriers or courier partners.
• We shall not be responsible for losses arising from delayed delivery where such delay is outside our control.
• Delivery schedules may be affected by peak seasons, weather events, transportation disruptions or operational constraints.

Force Majeure

Hero Pen India shall not be liable for any delay, failure or inability to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to Natural disasters, Floods, Fires, Earthquakes, Epidemics or pandemics, Government restrictions, Lockdowns, Customs delays, Labour strikes, Transportation disruptions, Courier service interruptions, War, Civil unrest, Power outages, Acts of God etc. in such circumstances, performance of our obligations may be suspended for the duration of the event.

Pricing Error Policy

While we make every effort to ensure pricing accuracy, errors may occasionally occur.

• Pricing errors may occur due to technical, human or system-related issues.
• If a pricing error is identified after an order has been placed, we reserve the right to cancel the order or offer the customer the opportunity to reconfirm the order at the correct price.
• If payment has already been received and the order is cancelled, a full refund will be issued to the original payment method.
• Hero Pen India shall not be obligated to fulfill orders placed at incorrect prices resulting from errors.

Returns and Refunds

Returns and refunds are subject to our Return & Refund Policy.

• Returns are accepted for unused and undamaged products in their original packaging.
• All refund requests will be processed after inspection and verification of the returned product.

Intellectual Property

The content available on our website, including but not limited to Text, Product descriptions, Images, Logos, Graphics, Designs, Layouts, Trademarks is the property of Hero Pen India and/or its licensors.

You may not copy, reproduce, distribute, modify, republish or commercially exploit any content without prior written permission.

Nothing in this Shipping Policy shall limit or exclude any rights available to consumers under applicable laws.

Disclaimers

The Content and Creator Content on the Platform are provided on an "as is" basis.

We do not make any warranties, express or implied, including but not limited to Merchantability, Fitness for a particular purpose, Non-infringement, Continuous availability, Error-free operation.

Governing Law & Jurisdiction

These Terms and Policies shall be governed by and construed in accordance with the laws of India.

Any disputes arising out of or relating to the use of our website, products or services shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu.
